{"id":504,"date":"2018-01-12T22:15:50","date_gmt":"2018-01-12T22:15:50","guid":{"rendered":"http:\/\/ceo.com.pl\/en\/?p=504"},"modified":"2018-01-25T11:15:43","modified_gmt":"2018-01-25T11:15:43","slug":"an-overview-of-the-planned-changes-in-the-real-estate-law-in-poland-2018-2018","status":"publish","type":"post","link":"https:\/\/ceo.com.pl\/en\/an-overview-of-the-planned-changes-in-the-real-estate-law-in-poland-2018-2018\/","title":{"rendered":"An overview of the planned changes in the real estate law in Poland 2018"},"content":{"rendered":"<h3>If the forthcoming changes in the law come into effect in the New Year, investors are in for quite a revolution in real estate<\/h3>\n<p><b>Planned changes related to decisions concerning planning permit:<\/b><\/p>\n<ul>\n<li>decisions concerning planning permit will be issued only to the owner\/perpetual usufructuary of a given real estate;<\/li>\n<li>a 3-year period of validity;<\/li>\n<li>as a rule, it will be possible to issue decisions concerning planning permission exclusively for land located in so-called developed areas (a given area will be established by a municipal council by way of a resolution which constitutes local government legislation).<\/li>\n<\/ul>\n<p><b>Planned changes related to building permits:<\/b><\/p>\n<ul>\n<li>a ban on issuing \u201cstage-by-stage\u201d building permits;<\/li>\n<li>lack of the possibility to cancel a building permit after five years from the date of an occupancy permit\/construction completion notice;<\/li>\n<li>a more extensive list of construction projects for which no building permit will be required.<\/li>\n<\/ul>\n<p><b>Planned changes related to reprivatization claims (\u201ca large reprivatization act\u201d):<\/b><\/p>\n<ul>\n<li>termination of reprivatization claims;<\/li>\n<li>converting reprivatization claims into rights to compensation for seized real estate (lack of possibility to return real estate in kind);<\/li>\n<li>all court, court-and-administrative, and administrative proceedings pending, related to reprivatization claims (except for proceedings before the Verification Commission for Reprivatization) will be discontinued.<\/li>\n<\/ul>\n<p><b>Adopted amendments to the water resources law (the amendment came into effect on 1 January 2018!):<\/b><\/p>\n<ul>\n<li>pre-emption rights to real estate on which there are lentic inland waters;<\/li>\n<li>new annual charges for real estate with a surface area in excess of 3,500 m2, with no sewage systems and not reclaimed;<\/li>\n<li>the need to obtain a water quality impact assessment for construction projects specified in the decree.<\/li>\n<\/ul>\n<p><strong>Author:<\/strong> PwC<br \/>\n<strong>Source:<\/strong> https:\/\/www.pwc.pl\/en\/artykuly\/2018\/real-estate-law-what-can-investors-expect-in-2018.html<\/p>\n","protected":false},"excerpt":{"rendered":"<p>If the forthcoming changes in the law come into effect in the New Year, investors are in for quite a revolution in real estate Planned changes related to decisions concerning planning permit: decisions concerning planning permit will be issued only to the owner\/perpetual usufructuary of a given real estate;
